6.1.E. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> October 8, 2012 <br /> SUBJECT <br /> Grant Deed for two one-foot parcels located on Maple Street to the County of San <br /> Mateo and License Agreement with County of San Mateo for use of a portion of Maple <br /> Street right-of-way for parking in support of the County Jail Project <br /> RECOMMENDATION <br /> By motion, approve and authorize the City Manager to execute two Grant Deeds for <br /> one-foot parcels located on Maple Street to the County of San Mateo and a License <br /> Agreement with the County of San Mateo for the use of City property for County Jail <br /> Parking. <br /> BACKGROUND <br /> In 2010, as a part of a Memorandum of Understanding with San Mateo County, the City <br /> agreed to transfer two one-foot slivers of land that separate Maple Street from the <br /> property the County was acquiring on Chemical Way for its proposed new jail. At the <br /> time, the City's Charter did not enable this action, so the City anticipated that the <br /> transfer would be a two-step process: the City would transfer the properties to the <br /> Redevelopment Agency, and then the Agency would transfer the property to the <br /> County. <br /> In the intervening years the City amended its Charter and the Redevelopment Agency <br /> was dissolved. Because the transfers to the County were contingent on certain County <br /> actions, which have only just begun, the title was never recorded in favor of the <br /> Redevelopment Agency. Consequently, title to the strips remains with the City. <br /> ANALYSIS <br /> The Sheriff's department approached the City about not only the transfer of the two <br /> strips of land, but also requesting an agreement for the continued use of a portion of the <br /> Maple Street right-of-way as surface parking. There is a flat area between the property <br /> lines of the Chemical Way lots, within the Maple Street right-of-way, that is now used as <br /> surface parking. The efficient development of the jail site also envisions surface <br /> parking in this area. <br /> In order to allow the County clear access to the City's property, staff has prepared and <br /> recommends approval of a license agreement with the County for the use of the Maple <br />
