10~27~2003 <br /> <br /> (a) Twenty percent (20%) of the total dwelling units of a housing <br />development for lower income households as defined in Health and Safety Code <br />Section 50079.5; or <br /> <br /> (b) Ten percent (10%) of the total dwelling units of a housing <br />development for very Iow income households as defined in Health and Safety Code <br />Section 50105; or <br /> <br /> (c) Fifty percent (50%) of the total dwelling units of a housing <br />development for senior citizens as defined in Civil Code Section 51.3; or <br /> <br /> (d) Twenty percent (20%) of the total dwelling units in a condominium <br />project as defined in subdivision (f) of Section 1351 of the Civil Code, for persons and <br />families of moderate income as defined in Section 50093 of the Health and Safety <br />Code. <br /> <br /> 2. Duration of Affordability. If one incentive is granted, then affordable <br />dwelling units shall be restricted to use as affordable dwelling units for a minimum <br />period of thirty (30) years. If the housing is a condominium project as defined in <br />subdivision (f) of section 1351 of the Civil Code, then the affordable dwelling units shall <br />be restricted to use as affordable dwelling units for a minimum period of ten (10) years. <br />"Affordable Dwelling Units" as used in this section means dwelling units which conform <br />to the criteria established in subsection (B)(1) above. <br /> <br /> C. Density Bonus/Incentives. <br /> <br /> 1. Except as provided in paragraph (2) and other than condominium <br />conversion projects, housing developments which provide affordable dwelling units <br />pursuant to the provisions of this section shall be granted a Density Bonus. "Density <br />Bonus" as applied to housing developments, means a density increase of at least <br />twenty-five percent (25%), unless a lesser percentage is elected by the applicant, over <br />the otherwise maximum allowable residential density under the applicable zoning <br />district regulations and Land Use element of the General Plan of Redwood City as of <br />the date the development application by the applicant is accepted by the City. The <br />density bonus shall not be included when determining the number of housing units <br />which is equal to ten (10%), twenty (20%), or fifty percent (50%) of the total dwelling <br />units. <br /> <br /> 2. If development does not meet requirements of (a), (b), or (c) of <br />subdivision (B)(1), but the applicant proposes to construct a condominium project in <br />which at least twenty percent (20%) of the total dwelling units are reserved for moderate <br />income households as defined in Health and Safety Code Section 50093, a density <br />bonus of at least ten percent (10%) shall be granted, unless a lesser percentage is <br />elected by the applicant, over the otherwise maximum allowable residential density <br />under the applicable zoning district regulations and Land Use element of the General <br />Plan of Redwood City as of the date the development application by the applicant is <br /> <br />F:Atty/Ord/Ord. 183 2 1130-324 <br />101403 <br /> <br /> <br />
