(b) Brisbane shall provide quarterly reports to the other SMCTG members <br />detailing administrative overhead expenses, msintenance costs, and the status of the <br />Maintenance Fund. <br /> <br /> (c) The SMCTG member or members providing personnel for operation of the <br />simulators shall not be entitled to contributions from the other members for the cost of s~'ch <br />personnel. <br /> <br />6. Operation and Storage of Simulators: <br /> <br /> (a) When not in use, the simulators shall be stored in Brisbane as the primary <br />home base. <br /> <br /> (b) The simulators shall be awilable to all members of SMCTG on a daily basis <br />in Brisbane with advanced scheduling. In the event two or more requests by different <br />members are made for the equipment on or about the same time, the member first msl~ing <br />a request shall be the first to have use of the simulators. Each agency shall pay the cost of <br />fuel and supplies consumed during its use of the simulators or shall replace such fuel and <br />supplies before use of the simulators by another agency. <br /> <br /> (c) The simulators shall be rotated twice a year for. a period of no more than 60 <br />days to one location in the South Zone and one location in the Central zone to facilitate <br />utilization of the simulators by SMCTG members in those zones, The simulators will <br />continue to be available to all members of SMCTG on a daily basis. <br /> <br /> (d) The simulators may be used by a non SMCTG member only at the Brisbane <br />site and provided a qualified SMCTG instructor is present and operating the equipment. A <br />use fee of $75.00 per day, or part of a day, per student per simulator for such use will be <br />charged to cover the costs of fuel and supplies and to include a portion for msintenance and <br />all other costs incurred due to that use. Additionally, a fee to cover any personnel costs for <br />the SMCTG instructor shall be added. Brisbane, as administrator of this Agreement, shall <br />be the agency to evaluate and authorize such non-member use. SMCTG members shall <br />have first priority for use of any of the simulators. Before shy use of the simulators by a <br />non-member is allowed, the non-member shall deliver to Brisbane: (i) a duly executed hold <br />ha~-~uless and indemnity agreement releasing the SMCTG members from any liability for <br />bodily injury or property damage resulting from the non-member's use; and (ii) evidence of <br />liability insurance coverage of not less thsn five million, naming the SMCTG members as <br />additional insureds, and otherwise in compliance with Brisbane's customary liability <br />insurance standards. <br /> <br /> (e) Only trained proctors shall be allowed to operate the simulators. <br /> Representatives from the three zones in San Mateo County shall be trained as simulator <br /> operators. The Technical Operations Manual and safety procedures shall be followed at all <br /> times when using the simulators. The Operations Committee may establish additional <br /> rules and regulations for use of the simulators, which shall be conspicuously posted on the <br /> equipment. There shall be no over riding of any safety feature of any of the simulators at <br /> any time. <br /> <br /> Rev. 7/21/03 -4- <br /> <br /> <br />
