10/22/2003 14:13 5502519102 RWC CITY CLERK PAGE 15 <br /> <br /> lb) Providing that Consultant's insurance shall apply separately to each <br /> <br /> insured against whom claim is made or suit is brought, except with respect <br /> to the limits of the insurer's liability (cross liability endorsement); <br /> <br /> lc) Naming City of Redwood City, Redwood City Redevelopment Agency, <br /> their councils, boards, officers, commissions, employees, and agents, as <br /> additional insureds; and <br /> <br /> (d) Providing that Consultant's insurance coverage shall be primary <br /> <br /> insurance with respect to City, Agency, their councils, boards, officers, <br /> commissions, employees, and agents, and any insurance or self- <br /> insurance maintained by City, Agency, and their council, boards, officers, <br /> commissions, employees, or agents shall be in excess of Consultant's <br /> insurance and not contributory with it. <br /> <br /> 14. COVENANT AGAINST CONTINGENT FEES, Consultant hereby <br /> warrants that with the exception of sub-consultants approved in accordance with <br /> Section 4 above, Consultant has not employed or retained any company or person, <br /> other than a bona fide employee working for Consultant, to solicit or secure this <br /> Agreement, and Consultant has not paid or agreed to pay any company or person, <br /> other than a bona fide employee, any fee, commission, percentage, brokerage fee, gift, <br /> or any other consideration contingent upon or resulting from the award or formation of <br /> this Agreement.
