Pursuant to California Government Code Section 8546.7 the parties to this Agreement <br />shall be subject to the examination and audit of representative of the Auditor General of <br />the State of California for a period of three (3) years after final payment under the <br />Agreement. The examination and audit shall be confined to those matters connected <br />with the performance of this Agreement including, but not limited to, the cost of <br />administering the Agreement. <br />11. SECURITY. Developer shall cause Wentz Group to require each and every <br />subcontractor performing dewatering, shoring, piling, structural concrete, waterproofing, <br />plumbing, fire protection, HVAC, or electrical work in connection with the Public Parking <br />Facility, and any other contractors that the Developer and City agree upon, prior to the <br />commencement of excavation, or construction in connection with the Project, to furnish <br />to City and Agency, and file with the City Clerk and Agency Secretary, a bond or <br />instrument of credit of the kind described in Section 66499, et seq. of the California <br />Government Code, securing the faithful performance of the Contractor's obligations <br />under this Agreement within the time herein specified, which bond or instrument of <br />credit shall be in an amount determined by the City and Agency. Developer shall <br />likewise cause each and every Contractor performing dewatering, shoring, piling, <br />structural concrete, waterproofing, plumbing, fire protection, HVAC, or electrical work in <br />connection with the Project, and any other contractors that the Developer and City <br />agree upon, prior to the commencement of excavation or construction in connection <br />with the Project, to furnish and file with the City Clerk and Agency Secretary a bond, <br />deposit, or instrument of credit of the kind described in Sections 66499 et seq. of the <br />California Government Code securing the payment by Contractor for labor, materials, <br />equipment or services furnished in connection with the Project and the doing of all other <br />work herein agreed to be done by Developer. The amount of the security shall be One <br />Hundred Percent (100%) of the value of the Contractor's contract for the Project. The <br />security shall include, in addition to the principal amounts, a guarantee of the payment <br />of costs and reasonable expenses and fees, including reasonable attorneys' fees, <br />incurred by City and/or Agency in the event of successful enforcement of such security. <br />All bonds shall be issued by a corporate surety admitted in the State of California and <br />shall name the City and the Agency as joint obligees. <br />Atty/Agr/Agr.147 <br />101403 Final <br />L.
