2. SCOPE OF WORK. <br />A. Developer shall be responsible for providing all personnel, equipment, <br />materials and services, either itself or through consultants and contractors acceptable to <br />City, to do all of the following: <br />i. Construct the Public Parking Facility described in the DDA and in <br />accordance with construction documents (construction plans and specifications) <br />prepared by or on behalf of Developer pursuant to the Pre-Construction <br />Agreement and approved by City and Agency; and <br />ii. Provide construction project management, testing, inspection and <br />architectural and engineering construction administration for the activities <br />described above. <br />The activities described in this paragraph 2A shall be referred to collectively as <br />the "Services", and are more fully described in Exhibit A, which Exhibit is attached <br />hereto and incorporated herein by this reference. The parties anticipate amending this <br />Agreement to address the design and construction of streetscape improvements at the <br />Project Site. <br />B. Developer shall contract for construction of the Public Parking Facility with <br />one or more contractors satisfactory to City and Agency, each of whom shall hold a <br />valid contractors license in the State of California issued by the Contractors State <br />License Board and be experienced in the work to be performed. These firms shall be <br />referred to collectively in this Agreement as "Contractors." To the extent required by <br />law, Developer shall pay, and shall require the Contractors to pay, prevailing wages and <br />comply with all related labor and employment requirements as applicable to the Public <br />Parking Facility pursuant to Labor Code Section 1770 et seq. <br />C. Developer shall itself or through contracts with professional consultants <br />satisfactory to City and Agency provide construction project management, inspection, <br />surveying and other professional services required for construction of the Public Parking <br />Facility. These firms shall be referred to collectively in this Agreement as "Consultants". <br />To the extent required by law, Developer shall pay, and shall require the Consultants to <br />pay, prevailing wages and comply with all related labor and employment requirements <br />as applicable to the Public Parking Facility pursuant to Labor Code Section 1770 et seq. <br />Atty/Agr/Agr.147 <br />101403 Final <br />L.
