. , 12/16/96 <br /> �. <br /> 0 R I G I N A ;. <br /> RESOLUTION NO. 12976 <br /> RESOLUTION APPROVING AND AUTHORIZING <br /> EXECUTION OF AMENDMENT TO AGREEMENT GRANTING <br /> A NON-EXCLUSIVE PERMIT AGREEMENT <br /> FOR THE INSTALLATION AND MAINTENANCE OF <br /> RADIO REPEATERS WITHIN THE PUBLIC RIGHT-OF-WAY <br /> (METRICOM, INC.) <br /> WHEREAS, the City Council of the City of Redwood City granted a Non <br /> Exclusive Permit to Metricom, Inc., a Delaware Corporation, (the "Permit") to <br /> install and maintain radio repeaters on certain street light poles and traffic signal <br /> structures located within the public right of way within the limits of the City of <br /> Redwood City, (form dated 9/21/95), as evidenced by Resolution 12603, adopted <br /> September 25, 1996; and <br /> WHEREAS, the City and Metricom, Inc., desire to enter into an <br /> amendment to the Permit to extend the term of the Permit and provide for the <br /> payment by Metricom, Inc. to City of a percentage of Metricom Inc.'s gross <br /> revenues collected from Redwood City subscribers of the services provided by <br /> Metricom, Inc.; <br /> NOW, THEREFORE; <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD <br /> CITY, as follows: <br /> That certain amendment to the Permit entitled "Amendment to Non- <br /> Exclusive Permit Agreement Between the City of Redwood City and Metricom <br /> Inc.," (form dated 11/15/96), by and between the City of Redwood City, a <br /> municipal corporation of the State of California and Metricom Inc., a copy of <br /> 12976 <br />
