6.2.A. - Page 1 <br /> `RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> November 19, 2012 <br /> SUBJECT <br /> Summary Vacation of Public Right-of-Way on Oakwood Drive <br /> RECOMMENDATION <br /> Adopt a resolution summarily vacating a Public Right-of-Way on Oakwood Drive <br /> dedicated and accepted for public use as described in Exhibit A1 & B1 to the proposed <br /> resolution. <br /> BACKGROUND <br /> The development of a new assisted living facility approximately 37,000 square foot, two- <br /> story building, containing 45 assisted care living units has been proposed at 2808 EI <br /> Camino Real, corner of Oakwood Drive and EI Camino Real. The developer of the <br /> proposed development has requested that the City vacate its public right-of-way interest <br /> over a strip of property adjacent to the property proposed for development. Oakwood <br /> Drive is a neighborhood street, with one lane in each direction, and a strip of public <br /> right-of-way adjacent to parcel 2808 EI Camino Real, reserved for a future designated <br /> right-turn lane. <br /> ANALYSIS <br /> Based on the traffic volume at Oakwood Drive, a designated right-turn lane is not likely to <br /> be necessary presently and in the future. Therefore, this portion of right-of-way is an <br /> excess right-of-way of a street not required for street purposes. Furthermore, there are <br /> no in-place public utility facilities that are in use that would be affected by the vacation. <br /> For this reason the city may seek a summary vacation rather than a general vacation of <br /> this property. <br /> The developer of the adjacent parcel, 2808 EI Camino Real, has requested that the City <br /> vacate this unused portion of right-of-way pursuant to the Street Vacation Act, California <br /> Streets and Highway Code, Section 8330 et seq. The City upon adoption of the <br /> proposed resolution, would relinquish its rights to use 1521 square feet of land at the <br /> subject location, and a title company would then determine proper ownership of the <br /> relinquished area which may revert to the owner of the 2808 EI Camino Real parcel. <br /> With the addition of the vacated parcel, the frontage of the proposed development at <br /> 2808 EI Camino Real may be made more attractive, and properly maintained, which will <br /> be a benefit to the community. <br />
