6.2. B. - Page 1
RE PO RT
To the Honorable Mayor and City Council
From the City Manager
November 19, 2012
SUBJECT
Resolution Waiving Notice of the County of San Mateo's Lease of Real Property
RECOMMENDATION
Adopt a Resolution waiving notice of the County of San Mateo's Lease of Real Property.
BACKGROUND
On November 2, 2012, San Mateo County advised the City of its intent to lease office
space at 555 Marshall Street. The lease will be presented to the Board of Supervisors
on November 20, 2012. Government Code Section 25351 requires that whenever the
board of supervisors of a county decides to enter into a lease of an existing building
within the incorporated territory of a city, the board shall notify in writing, at least 60
days prior to entering into a lease, the city clerk of the city where the building is to be
leased. Pursuant to Government Code Section 25351, the City can, by resolution,
agree to waive the required 60-day notice.
ANALYSIS
The County has requested the City Council adopt a resolution waiving the 60-day
noticing requirement. The County intends to lease space at 555 Marshall Street and in
turn enable the San Mateo Credit Union to move from their current headquarters into
this building while their property is redeveloped.
By adopting the attached resolution, the City Council enables the County to move
forward with the lease without delay and, consequently, enables the Credit Union to
continue its pursuit of the redevelopment of its headquarters' property. The
redevelopment of this site is consistent with the Downtown Precise Plan and potentially
a significant housing and office development.
ALTERNATIVES
If the City Council chooses to not adopt the resolution, then a 60-day public notice
requirement would be in effect. Such action likely delays the redevelopment of the
Credit Union property.
FISCAL IMPACT
There is no fiscal impact directly connected to this action.
