11/19/2012 <br /> ORIGINAL <br /> RESOLUTION NO. 15228 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> CITY SUMMARILY VACATING EXCESS PUBLIC RIGHT OF WAY ON <br /> OAKWOOD DRIVE ADJACENT TO 2808 EL CAMINO REAL <br /> WHEREAS, the City of Redwood City ("City") is responsible for the public right- <br /> of-way dedicated on that certain Map entitled "Ackerson and Lathrop's Land in San <br /> Mateo County" filed for record on July 1, 1863 in the Office of the County Recorder on <br /> page 51 of Book 3; and <br /> WHEREAS, a developer, Interra Development Partners, LLC, for development <br /> proposed at 2808 EI Camino Real has requested that the City vacate a portion of the <br /> Oakwood Drive right of way, identified as the shaded area depicted and described on <br /> Exhibits "A1" & "B1", attached hereto ("Vacation Area"); and <br /> WHEREAS, the total area of said Vacation Area is 1521 square feet, more or <br /> less; and <br /> WHEREAS, there are no in-place public utility facilities that are in use within the <br /> Vacation Area that would be affected by the vacation; and <br /> WHEREAS, Section 8334 of the Streets and Highways Code of the State of <br /> California allows a city to summarily vacate an excess right-of-way of a street or <br /> highway not required for street or highway purposes. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF REDWOOD CITY AS FOLLOWS: <br /> 1. The recitals set forth above are true and correct and are hereby <br /> incorporated by this reference as if fully set forth in their entirety. <br /> 2. Pursuant to Section 8334 of the Streets and Highways Code, the Vacation <br /> Area is an excess right-of-way of a street not required for street purposes. <br /> 3. Fro and after the date this Resolution is recorded with the County <br /> Recorder of the County of San Mateo, the right-of-way within the Vacation Area <br /> depicted and described in Exhibits "A1" & "B1" will no longer be City right-of-way, and <br /> shall no longer constitute a street. <br /> 4.
