BFI shall assume financial responsibility for the lease and any related expenses <br /> associated with the current Recyclery at 375 Quarry Road. <br /> <br /> B. Collection Agreement: BFI's existing obligations under the collection agreement shall <br /> remain unchanged. <br /> <br /> C. Recycling Agreement: The operation of the MRF including the maintenance and <br /> replacement or all equipment shall be incorporated into the obligations of BFI under the <br /> Recycling Agreement. All of BFI's other existing obligations under the agreement shall <br /> remain unchange¢ <br /> <br /> D. Green Waste Program; BFI shall develop, permit and implement, by March 1,1994, a <br /> Green Waste program that diverts sufficient quantities of waste (currently assumed to <br /> be 20% of the SBTSA member agencies waste stream) in a manner acceptable to the <br /> California integrated Waste Management Board (for purposes of achieving the source <br /> reduction and recycling goals in 1995 and 2000 contained in the Integrated Waste <br /> Management Act of 1989) and in accordance with the cities' SRREs at a price <br /> acceptable to the SBTSA member agencies.. <br /> <br />IV. Obligations of the SBTSA <br /> <br /> A. Transfer Station Agreement: The SBTSA member agencies shall direct any future <br /> curbside recycling franchisees to use the facility during the term of the agreement, to <br /> the extent the facility is designed to process the materials collected, All of the SBTSA's--- <br /> existing obligations under the Transfer Agreement shall remain unchanged. <br /> <br /> B. Collection Agreement: Ali of the SBTSA's existing obligations under the Collection <br /> Agreement shall remain unchanged. <br /> <br /> C. Recycling Agreement: All of the SBTSA's existing obligations under the Recycling <br /> Agreement shall remain unchanged.. <br /> <br />V, SBTSA's Right to Purchase: <br /> <br /> A. If the SBTSA' exercises this right, it must acquire both the Transfer Station and MRF <br /> facilities. <br /> <br /> B. SBTSA may purchase the administration building (located adjacent to the Transfer <br /> Station) and the MRF (including land, buildings and equipment) at their net book value <br /> on the purchase date. <br /> <br /> Page 2 of 5 <br /> <br /> <br />
