DES:djk 08/31/87R <br /> <br />findings, the basis therefor, and a recommended action by the <br />Governing Body. <br /> <br /> Section 8.3. Governing Bod~ Review. Company may appeal a <br />Compliance Order issued by the Manager to the Governing Body by <br />filing a notice of appeal with the Clerk of the Governing Body <br />within 10 days of the date of the Manager's Compliance Order. <br />The Clerk of the Governing Body shall set the matter for hearing <br />by the Governing Body within 30 days of receipt of the notice of <br />appeal unless Company consents to an extension of the time for <br />the hearing. <br /> <br /> If the Manager orders a Complaint to be heard by the <br />Governing Body pursuant to Section 8.2, the Clerk of the <br />Governing Body shall set the matter for hearing.within 30 days of <br />the date of such order, unless the time for hearing is extended <br />by consent of Company. <br /> <br /> ~t its hearing, the Governing Body shall consider the <br />Complaint anew, irrespective of whether the hearing is on appeal <br />by Company or by order of the Manager. If a Complaint is based <br />upon the manner or quality of Company's service to customers or <br />members of the public, the hearing shall be a public hearing. If <br />a Complaint is based upon a violation of the standards and <br />procedures implemented under Section 5.1 or of the provisions of <br /> <br />Sections 5.2, 5.3, 5.4, 5.6, or 5.7, the hearing may, but shall <br />not necessarily, be a public hearing as the Manager shall <br />determine. <br /> <br /> Agency and/or Company shall have the right to request that <br />the Complaint be referred to a fact finding panel pursuant to <br />Section 8.4 prior to hearing and final determination by the <br />36 <br /> <br /> <br />
