DES:djk 08/31/87R <br /> <br />of its duties or obligations either express or implied, under <br />this agreement, the Governing Body may order termination of this <br />agreement. Such Termination Order shall be effective not less <br />than 30 days from the date of the Termination Order. Company <br />shall not be entitled to any further revenues from Collection <br />operations authorized hereunder from and after the effective date <br />of termination. <br /> <br /> (d) Order for Payment of Compensatory Damages. If the <br />Governing Body determines that Company has violated, or is in <br />continuing violation of, any of its duties or obligations, either <br />express or implied, under this agreement which has caused loss of <br />revenues to Agency, or caused Agency to incur unnecessary costs <br />or has caused loss or damages to any person, it may order Company <br />to pay compensatory damages therefor to Agency, or to the person <br />so damaged. <br /> <br /> ARTICLE IX. <br /> <br /> EMERGENCY OPERATIONS <br /> <br /> Section 9.1. Purpose. The purpose of this Article is to <br />provide a procedure for Collecting Solid Waste from Agency's <br />Service Area upon the occurrence of an Emergency Condition <br />resulting from the causes described in Section 9.2 which endanger <br />the public health, safety and welfare. The parties acknowledge <br />that either temporary cessation or cessation of indeterminate <br />duration of the services to be provided by Company hereunder may <br />result in conditions detrimental to the public health, safety and <br />welfare and that, in order to protect the public, invoking the <br />extraordinary provisions of this Article may be necessary. <br /> <br /> 39 <br /> <br /> <br />
