1 b) Equipment to be utilized (vehicle number, types, capacity, age, etc.). <br />2 c) Labor requirements (number of employees by classification). <br />3 d) Type of Containers to be utilized. <br />4 e) Provision for public education/marketing. <br />5 f) A projection of the financial results of the program's operations in a <br />6 balance sheet and operating statement format, including documentation <br />7 of the key assumptions underlying the projections and the support for <br />8 those assumptions for the remaining term of the Agreement. <br />9 3.8.3 Agency's Right to Acquire Services <br />10 Company acknowledges and agrees that Agency may permit other persons <br />11 besides Company to provide additional services not otherwise contemplated <br />12 under Section 3.6 of this Agreement. If pursuant to Section 3.8.2, Company and <br />13 Agency cannot agree on terms and conditions of such services within ninety (90) <br />14 days from the date when Agency first requests a proposal from Company to <br />15 perform such services, Company acknowledges and agrees that Agency may <br />16 solicit proposals from and permit persons other than Company to provide such <br />17 services. <br /> <br />18 3.8.4 Implementing New Services <br />19 If (a) Company is capable of performing or developing the ability to perfon¥~ a <br />20 requested service or modifying an existing service; (b) Agency has agreed to <br />21 have Company provide such additional service in accordance with Company's <br />22 Proposal; and, (c) an adjustment in Company's compensation has been agreed to <br />23 pursuant to Section 6.4 of this Agreement, Company shall commence the new or <br />24 changed service. If Agency and Company are unable to agree on the amount of ' <br />25 Company's compensation adjustment within forty-five (45) days of receipt of <br />26 Agency's proposal, Agency may penYdt a third party to provide such additional <br />27 or modified services, and Company shall not be obligated to perform same <br />28 services. <br /> <br /> Page 15 8/2/96 <br /> <br /> <br />
