1 B. Resumption of Service. Upon the declaration of cessation of the Emergency <br />2 Condition, the Emergency Operator shall return to Company its vehicles, <br />3 equipment, and other facilities acquired and used by it under Section 9.4 <br />4 Further, upon the declaration of cessation of the Emergency Condition, and <br />5 unless Agency has terminated this Agreement pursuant to Section 9.7, <br />6 Company shall recommence its operations hereunder and shall perform ail of <br />7 its duties and obligations in accordance with the provisions hereof, and shall <br />8 be entitled to all of its rights hereunder, including accrual of revenues for its <br />9 benefit, from and after the date upon which the Emergency Condition shall <br />10 be deemed to have ceased. <br />11 C. Limitation. Notwithstanding anything herein contained to the contrary, no <br />12 Emergency Condition shall exist for more' than 180 consecutive days. Upon <br />13 the expiration of said 180 days, and unless the Emergency Condition has <br />14 ceased prior thereto, this Agreement shall terminate. In the event of such <br />15 termination, no rights shall accrue to Company under this Agreement from <br />16 and after the date of termination. <br /> <br />17 9.7 Agency .Termination of Agreement <br />18 Notwithstanding the provisions of Section 9.6, if, upon the cessation of the <br />19 Emergency Condition, Agency's Governing Body determines (irrespective of <br />20 contrary determinations by Authority or other member agencies of Authority) <br />21 that Company is not substantially able to perform its duties and obligations <br />22 hereunder due to the effects of the Emergency Condition, the Governing Body <br />23 may declare this Agreement terminated effective upon the date of the cessation <br />24 of the Emergency Condition.
