10.5 Assurance of Performance <br /> <br /> Agency may, at its option and in addition to all other remedies it may have, <br /> demand from Company reasonable assurances of timely and proper <br /> performance of its material obligations under this Agreement, in such form and <br /> substance as Agency may require. If Company fails or refuses to provide <br /> satisfactory assurances of timely and proper performance of its material <br /> obligations under this Agreement, in the form and by the date required by <br /> Agency, such failure or refusal shall be an event of default. <br /> <br />9 10.6 Damage to Property. <br />10 Company shall endeavor to resolve all claims as soon as reasonably practicable <br />1! following receipt thereof, made by owners or occupants of property served by <br />12 Company, for damages to property including, but not limited to, Containers. In <br />13 the event such damage shall have been caused by the nggligence or intentional <br />14 acts of Company, its officers, agents, or employees, Company shall promptly <br />15 repair or replace such damaged property. The provisions of this Section 10.6 shall <br />16 not be deemed a limitation upon any other provisions of this Agreement, or any <br />17 rights or remedies which may accrue to Agency by reason of Company's acts or <br />18 omissions to act hereunder. <br /> <br /> Page58 8/2/96 <br /> <br /> <br />
