Bell and Lyon, <br /> This firm is legal counsel for the Regatta Residential Association, a condominium project <br /> located in the City of Redwood City. As we have recently discussed with Mr. Lyon, the <br /> Association plans to vote on an amendment to its CC8�Rs which would shift responsibility for <br /> maintenance, repair, and replacement of exterior windows and sliding glass doors from the <br /> Association to the individual Unit Owners. The Association's Board and its Members have been <br /> operating under the belief that Owners are responsible for the exterior windows and sliding <br /> glass doors for many years, so this amendment is intended only to conform the governing <br /> documents to current practices. <br /> Why We Are Contacting You <br /> We are contacting you because Section 5.1.4 of the Declaration of Covenants, <br /> Conditions 8 Restrictions of Regatta a Condominium Project, recorded on April 25, 1989, in the <br /> Official Records of the County Recorder of San Mateo County ("current CC&Rs") contains the <br /> following requirement: <br /> Amendment. No amendment or modification of this Declaration that <br /> would affecf the terms and provisions of this Declaration as it relates <br /> to the maintenance responsibilities of fhe Association, or which would <br /> terminate or materially impair fhe rights of the City as set forth in this <br /> Declaration, sha//be effective without the prior wriften consent of the <br /> City, as authorized by ifs City Manager. ' <br /> ' It is my understanding that you are in possession of a copy of the current CC&Rs. However, if that is not the case, <br /> please let me know and we will be happy to provide you with a complete copy. <br />
