California ("City") effective January 29, 2001 (the "Agreement"), until the recordation by <br />the Grantor of the Certificate of Completion described in Section 517 of the Agreement, <br />at which time only the covenants against discrimination set forth in the final paragraph of <br />this Grant Deed shall survive. <br /> <br /> The Grantor has the limited and conditional fight to the return of title and <br />possession of the Property and all improvements thereon, and to the termination and <br />revesting in the Grantor of the estate conveyed to the Grantee hereby, as such right is set <br />forth in Section 810 of the Agreement; provided that such right to reenter, take <br />possession, terminate, and revest shall expire and be of no further force or effect upon the <br />recordation by the Grantee of the Certificate of Completion. <br /> <br /> The Grantee herein covenants by and for itself, its heirs, executors, administrators, <br />and assigns, and all persons claiming under or through them, that there shall be no <br />discrimination against or segregation of, any person or group of persons on account of <br />race, color, creed, religion, handicap, sex, sexual preference, marital status, national <br />origin or ancestry in the sale, lease, sublease, transfer, use, occupancy, tenure, or <br />enjoyment of the premises herein conveyed, nor shall the Grantee or any person claiming <br />under or through the Grantee, establish or permit any such practice or practices of <br />discrimination or segregation with reference to the selection, location, number, use, or <br />occupancy of tenants, lessees, subtenants, sublessees, or vendees in the premises herein <br />conveyed. The covenants against discrimination set forth in the preceding sentence shall <br />mn with the Property, and every deed, lease, or contract affecting the Property shall <br />contain the language appropriate therefor as set forth in Section 33436 of the <br /> <br />Health and Safety Code, as the same shall exist on the date of execution of such deed, <br />lease, or contract. <br /> <br />DATED: <br /> GRANTOR <br /> <br /> -2- <br /> <br /> <br />
