February 9, 2004

Subject
Final Acceptance - Realignment of Reinforced Concrete Box Culvert in the Downtown
Area.

Recommendation
Accept the improvements for the Realignment of the Reinforced Concrete Box Culvert
in the Downtown Area, and release the bonds and retention.

Background
On February 24, 2003, the City Council and the Redevelopment Agency approved the
Construction and Reimbursement Agreement with BHV Innisfree Ventures I for the
relocation of the Reinforced Concrete Box Culvert, in the Downtown Area.

Subsequently, on March 24, 2003, the City Council and Redevelopment Agency
approved the contract documents for the relocation of the concrete box culvert in the
downtown area in advance of the excavation and construction of the City's new
Underground Public Parking Facility.

The work has been completed on time, per approved plans, and within budget. There
were two additional Amendments that increased the cost (per City's request) to the
Guaranteed Maximum Price of Contract. These included:

1. Demolition of two buildings that were in conflict with the new culvert, and

2. Backfilling a portion of the old culvert over Jefferson Avenue and Middlefield
Road, and installation of a new storm drain system on Jefferson Avenue.

The Developer's contractor, Power Engineering Contractors, performed the work in a
diligent, caring, and extraordinary manner. They worked expeditiously and cooperatively
with City Staff and the local businesses in minimizing disruption, and providing traffic
control measures during construction.

The portion of the new culvert is approximately 1,000 feet long by 15.5 feet wide by 7
feet deep, and consisted of approximately 23,000 cubic yards of concrete which weighs
over 46 tons and contains over 350,000 pounds of steel. This weight would be
equivalent of approximately 24,000 average size vehicles!
