<br />ORIGINAL <br /> <br />AMENDMENT NO.2 TO EXTEND AND AMEND AGREEMENT FOR <br />PROFESSIONAL FINANCIAL CONSULTING SERVICES <br />(Bartle Wells Associates) <br /> <br />This Amendment No.2 is entered into and effective as of the~+day of <br />~ Er( j.Q/yn{) 'w~'Î ' 2005, extending and amending the agreement dated <br />February 12, 2004 (the "Agreement") by and between the City of Redwood City, a <br />charter city and municipal corporation of the State of California ("City"), and Bartle Wells <br />Associates, a California Corporation, ("Consultant") (collectively, the "Parties") for <br />professional services and advice relating to public utility financial planning. <br /> <br />RECITALS <br /> <br />A. On January 7, 2005, the Parties executed Amendment No.1 to the <br />Agreement to amend Scope of Services and Fees; and <br /> <br />B. The Parties desire to alter the Agreement's scope of work to include <br />additional hours to update the 2005 Water Financing Plan, which is required for Council <br />approval before they authorize the second water bond issue for the Recycled Water <br />Project; and <br /> <br />C. The Parties have negotiated and agreed to a supplemental scope of work <br />as described above; and <br /> <br />D. The Parties have negotiated and agreed to a new fee schedule, which is <br />attached to and incorporated in by this reference as Exhibit "B". <br /> <br />NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br />contained herein, the Parties agree as follows: <br /> <br />1. That the Agreement, as may have been amended from time to time, is <br />hereby extended to cover those services as outlined above and Consultant will be paid <br />a not to exceed amount of Fifteen Thousand dollars ($15,000.00). <br /> <br />2. In addition to those services contained in the Agreement, as may have <br />been amended from time to time, Consultant will provide those services as described <br />above. The amended not to exceed total compensation is now Sixty Thousand dollars <br />($60,000.00). <br /> <br />3. All other provisions of the Agreement, as may have been amended from <br />time to time, will remain in full force and effect. <br /> <br />4.
