7.A. - Page 17 <br /> Sec. 38.41 Fees <br /> A. Administrative Fee (Cross-Connection Reqistration Fee and Annual Test Result/Record <br /> Filinq Fee): The Customer-user owninq and/or occupvinq propertv on which backflow <br /> preventers are repuired to be installed shall pay to the City an administrative fee in an <br /> amount established by Council resolution at the time the backflow preventer is first <br /> reqistered with the Citv and aqain each vear with the filinq of the test results. Such fees shall <br /> be included as part of the Customer-user's municipal water bill and must be paid by the <br /> Customer-user in the same manner as the water bill. <br /> 8. Operational Testinq Fee: In the event the Director provides backflow preventer testinq <br /> services, persons availinq themselves of such services shall pav the testinq fee established <br /> by Council resolution. Such fee shall be included as part of the Customer-user's next <br /> ensuinq municipal water bill and must be paid by the Customer-user in the same manner as <br /> the water bill. <br /> C. Inspection Fee: When the Director deems it appropriate to inspect the property of a <br /> Customer-user, the Customer-user shall pay the Inspection Fee established by Council <br /> resolution. Such fee shall be included as part of the Customer-user's next ensuinq <br /> municipal water bill and must be paid bv the Customer-user in the same manner as the <br /> water bill. When the Director deems it appropriate to inspect any property which has a water <br /> connection to the Citv's water supplv to determine whether there exists on such propertv an <br /> unreported or unreqistered AuxiliarV Water SupplV or anV other condition which repuires <br /> installation of backflow preventers. If the Director determines that backflow preventer <br /> installation is repuired by this Article, the owner of such property shall pay the Inspection <br /> Fee established bv Council Resolution and anv penalties and fines authorized this Article. If <br /> the Director determines that no condition exists on such property which repuires backflow <br /> preventers, no inspection fee will be charqed to the property owner. <br /> Sec. 38.42 Cross Connection Prohibition <br /> A. It shall be unlawful for any person to construct, install, use, keep, or maintain, or to <br /> permit, cause, or allow the construction, installation, use, or maintenance of a cross- <br /> connection. <br /> B. It shall be unlawful for any person to construct or install, or to cause to be constructed or <br /> installed, a backflow prevention assembly which does not meet pertinent requirements of <br /> Title 17 of the California Administrative Code and Article VII (Plumbing Code) of Chapter <br /> 9 of this Code and all amendments thereto, and this Article. <br /> C. It shall be unlawful for any person to operate, use or maintain, or to permit, or cause the <br /> use, operation, or maintenance of any backflow prevention assembly which is not tested <br /> at least once each calendar year. <br /> D. It shall be unlawful for any person to use, operate, or maintain, or to permit or cause the <br /> use, operation, or maintenance of any backflow prevention assembly which is not in <br /> good repair. <br /> E. Any Customer-user whose property or premises with an Auxiliary Water Supply not in <br /> compliance with this Article shall inform the Director and take all repuired actions to <br /> come into compliance with this Article forthwith at Customer-user's expense. <br /> ATTY/FINAL ORD/2013/ORD.384/CROSS CONNECTION <br /> REV:01-08-13 PT <br /> Page 11 of 14 <br />
