6.5.B. - Page 1 RE PO RT To the Honorable Mayor and City Council From the Cit Mana er January 28, 2013 SUBJECT An Ordinance Amending Section 13.1 of Chapter 13 and Article VII of Chapter 38 of the City's Municipal Code Relating to the City's Cross-Connection Control Program RECOMMENDATION Waive Second Reading and Adopt an Ordinance Amending Section 13.1 of Chapter 13 and Article VII of Chapter 38 of the City's Municipal Code Relating to the City's Cross- Connection Control Program; and Adopt a Resolution of the City Council of the City of Redwood City Adopting an Amnesty Program for Compliance with the City's Cross-Connection Control Program. BACKGROUND The City Council Utility Subcommittee held several public meetings regarding the City's Cross-Connection Control Program. The meetings addressed the State of California's requirement that the City create a Corrective Action Plan to bring properties with auxiliary water supplies in the City into compliance with long-standing state requirements and the City's 2008 regulations following an incident in 2011 when the public water supply was contaminated as a result of a cross-connection between a private property owner's auxiliary water supply and the City's water supply. The proposed ordinance and resolution together would amend the program to both encourage compliance and provide additional tools to staff to enforce this important program. The Subcommittee recommends approval of the ordinance and resolution which the City Council reviewed and introduced during its January 14, 2013 meeting and additional details about the program are contained in the staff report presented during that meeting. The ordinance and resolution are presented now for adoption. ANALYSIS The proposed ordinance and resolution together would amend the City's Cross- connection Control Program as follows: • Implements an amnesty program by waiving certain fees for property owners with auxiliary water sources who come into compliance within one year and in order to avoid inequity for those who already complied, the program provides certain credits and fee waivers for compliant property owners.
