Administrative Fee (Cross-Connection Reqistration Fee and Annual Test ResulbRecord Filinq Fee): The Customer-user owninq and/or occupyinq property on which backflow preventers are repuired to be installed shall pav to the Citv an Administrative Fee at the time the backflow preventer is first reqistered with the Citv and aqain each vear with the filinq of the test results. 8. Operational Testinq Fee: In the event the Director provides backf/ow preventer testinq services, persons availinq themselves of such services shall pav an Operational Testinq Fee. C. Inspection Fee: The Customer-user shall pay an Inspection Fee when the Director deems it appropriate to inspect the propertv of a Customer-user in order to carrV out the purposes of this Article, includinq but not limited to inspectinq anv propertv which has a water connection to the City's water supply to determine whether there exists on such property an unreported or unreqistered Auxiliarv Water Supplv or anv other condition which repuires installation of backf/ow preventers. If the Director determines that backf/ow preventer installation is repuired by this Article, the owner of such property shall pay the Inspection Fee established bv Council Resolution and anv penalties and fines authorized this Article. If the Director determines that no condition exists on such propertv which repuires backflow preventers, no inspection fee will be charped to the propertv owner. Sec. 38.42 Cross Connection Prohibition A. It shall be unlawful for any person to construct, install, use, keep, or maintain, or to permit, cause, or allow the construction, installation, use, or maintenance of a cross- connection. B. It shall be unlawful for any person to construct or install, or to cause to be constructed or installed, a backflow prevention assembly which does not meet pertinent requirements of Title 17 of the California Administrative Code and Article VII (Plumbing Code) of Chapter 9 of this Code and all amendments thereto, and this Article. C. It shall be unlawful for any person to operate, use or maintain, or to permit, or cause the use, operation, or maintenance of any backflow prevention assembly which is not tested at least once each calendar year. D. It shall be unlawful for any person to use, operate, or maintain, or to permit or cause the use, operation, or maintenance of any backflow prevention assembly which is not in good repair. E. Anv Customer-user whose propertv or premises with an Auxiliarv Water Supplv is not in compliance with this Article shall immediately inform the Director and take all repuired actions to come into compliance with this Article at Customer-user's expense. Sec. 38.43 Rea/Estate Transfer Disclosure Statement In addition to disclosures repuired bv California Civil Code Section 1102.6a, the followinq additional disclosure shall be made: Upon anv transfer of real propertv. includinq but not limited to commercial and residential real properties, bv sale, exchanqe, installment land sale contract. lease with option to purchase, or qround lease coupled with improvements, or transfer of residential stock cooperative, the transferor shall provide to the buver an additional disclosure ATTY/FINAL ORD/2013/ORD.384/CROSS CONNECTION REV:01-17-13 PT Page 11 of 13
