7.A. - Page 25 <br /> Commission meeting. (Appeal, pp. 9-10.) Appellant does not identify any particular <br /> alleged violation. In addition, Appellant complains that the owner of Pete's Harbor, <br /> Paula Uccelli, made misleading statements in letters to her tenants. (Appeal, p. 3.) <br /> City's Position: Appellant's non-specific, generalized grievance does not serve as a <br /> basis for appeal. Appellant has not provided "any supporting information, materials and <br /> documents the appellant requests be considered by the reviewing body during the <br /> appeal hearing." (Zoning Code § 48.4.) Notwithstanding the foregoing, the City more <br /> than satisfied its legal obligations to provide notice of the Planning Commission meeting <br /> (see, e.g., Zoning Code § 49.4 and Gov. Code § 65901) including by: <br /> • Mailing notice to property owners and tenants within 300 foot radius of the site on <br /> October 3, 2012, including the State Lands Commission. <br /> • Publishing notice in the Redwood City Daily News on October 6, 2012. <br /> • Mailing notice to BCDC, C/CAG, San Francisco Regional Water Quality Control <br /> Board, California Department of Fish and Game and the U.S. Fish and Wildlife <br /> Service (responsible agencies). <br /> • Mailing notice to Save the Bay, Diana Reddy, and Chamber of Commerce <br /> (interested parties). <br /> • Providing on-site postings at Pete's Harbor, Villas at Bair Island, Marina Pointe <br /> and One Marina.' <br /> • Appellant's contentions that the property owner has misled her tenants raises <br /> issues relative to the landlord-tenant relationship, not the adequacy of any legally <br /> required notice associated with the City's process relating to the proposed <br /> development. Thus, this is not a valid grounds for the Appeal. In any event, the <br /> property owner and/or applicant have conducted public outreach with the <br /> stakeholders at Pete's Harbor, including a meeting with all tenants on September <br /> 20, 2012, and a meeting with the restaurant operator on September 19, 2012. <br /> Further, the property owner and/or applicant has met with owners and interested <br /> parties from nearby properties and businesses, such as the residents, <br /> purchasers and Homeowners' Association board members of One Marina Pointe <br /> and the management of The Villas at Bair Island, as discussed in the October 30, <br /> 2012, Planning Commission Staff Report at page 14. <br /> B. Affect on Neiqhborinq Property Values (Appeal, p. 7) <br /> ' Appellant suggests that notice should have been posted at the site after filing of the <br /> application, as well as prior to the September 19, 2012, architectural review hearing. <br /> (Appeal, p. 3.)
