arrac 7.A. - Page 29 WHEREAS, the Commission adopted Resolution No. 12-23 approving the Project, including the Planned Development Permit and the Vesting Tentative Map; and WHEREAS, the "Save Pete's Harbor 2012" association appealed the Commission's approval of the Project and adoption of Resolution No. 12-23 to the City Council; and WHEREAS, the City Council held a de novo hearing on January 28, 2012; and WHEREAS, the City Council conducted a duly noticed public hearing, in accordance with all applicable requirements of the State Planning and Zoning Law and the Redwood City Zoning Ordinance, to consider the appeal of the Project, and received and considered oral and documentary evidence on the appeal and application; and WHEREAS, the City Council considered the 2003 Marina's Shores Village Environmental Impact Report (EIR), Addendum No. 1 to the EIR and Addendum No. 2 to the EIR in accordance with the requirements of CEQA; and WHEREAS, the City Council determined that the Appeal raises no compelling factual or legal reason for reversing the Commission's approval of the Project and adoption of Resolution No. 12-23; and WHEREAS, the City Council determined that the proposed Planned Development Permit, including the requested parking exception and modifications, and Vesting Tentative Map would further the purposes of and appropriately implement the City of Redwood City General Plan, and applicable provisions of the Redwood City Municipal Code and Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: Section 1. The City Council finds that the above recitals are accurate and constitute findings in this matter and, together with the Staff Reports and the application materials, including without limitation consideration of EIR, Addendum No. 1 to the EIR, Addendum No. 2 to the EIR, Project plans, and all other documents, reports, studies, memoranda, maps, oral and written testimony, and materials in the City's file for the applications and the Project, and all adopted City planning documents relating to the Project and the ATIY/RE50.2825/PETE'S HARBOR REV:01-24-13 VR Page 2 of 15
