arrac 7.A. - Page 29 <br /> WHEREAS, the Commission adopted Resolution No. 12-23 approving <br /> the Project, including the Planned Development Permit and the Vesting <br /> Tentative Map; and <br /> WHEREAS, the "Save Pete's Harbor 2012" association appealed the <br /> Commission's approval of the Project and adoption of Resolution No. 12-23 to <br /> the City Council; and <br /> WHEREAS, the City Council held a de novo hearing on January 28, <br /> 2012; and <br /> WHEREAS, the City Council conducted a duly noticed public hearing, <br /> in accordance with all applicable requirements of the State Planning and <br /> Zoning Law and the Redwood City Zoning Ordinance, to consider the appeal <br /> of the Project, and received and considered oral and documentary evidence on <br /> the appeal and application; and <br /> WHEREAS, the City Council considered the 2003 Marina's Shores <br /> Village Environmental Impact Report (EIR), Addendum No. 1 to the EIR and <br /> Addendum No. 2 to the EIR in accordance with the requirements of CEQA; <br /> and <br /> WHEREAS, the City Council determined that the Appeal raises no <br /> compelling factual or legal reason for reversing the Commission's approval of <br /> the Project and adoption of Resolution No. 12-23; and <br /> WHEREAS, the City Council determined that the proposed Planned <br /> Development Permit, including the requested parking exception and <br /> modifications, and Vesting Tentative Map would further the purposes of and <br /> appropriately implement the City of Redwood City General Plan, and <br /> applicable provisions of the Redwood City Municipal Code and Zoning <br /> Ordinance. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF REDWOOD CITY AS FOLLOWS: <br /> Section 1. The City Council finds that the above recitals are accurate <br /> and constitute findings in this matter and, together with the Staff Reports and <br /> the application materials, including without limitation consideration of EIR, <br /> Addendum No. 1 to the EIR, Addendum No. 2 to the EIR, Project plans, and <br /> all other documents, reports, studies, memoranda, maps, oral and written <br /> testimony, and materials in the City's file for the applications and the Project, <br /> and all adopted City planning documents relating to the Project and the <br /> ATIY/RE50.2825/PETE'S HARBOR <br /> REV:01-24-13 VR <br /> Page 2 of 15 <br />
