6.1.D. - Page 27 NOW,THEREFORE, DECLARANT HEREBY DECLARES AS FOLLOWS: 1. Definitions. The capitalized terms in this Declaration of Annexation shall have the same meanings given them in the Declaration unless this Declaration of Annexation provides otherwise. 2. Annexation. Pursuant to the terms of the Declaration, Declarant, as owner of the real property in Phase 6,declares that: (a) Buildin�: Building 16 and Building 17, as shown on the Current Phase Condominium Plan and defined in the Declaration; (b) Buildin� Common Area: The designated Building Common Area for Building 16, and the designated Building Common Area for Building 17, as shown on the Current Phase Condominium Plan and defined in the Declaration; (c) Units: Units 1601 through 1603, Units 1605 through 1613, and Units 1615 through 1618, all located in Building 16 as shown on the Current Phase Condominium Plan and defined in the Declaration; (d) Units: Units 1701 through 1703, Units 1705 through 1713, and Units 1715 through 1718, all located in Building 17 as shown on the Current Phase Condominium Plan and defined in the Declaration; and (e) Association Common Area: Subject to subsection 2(� below, the Association Common Area as shown on the Current Phase Condominium Plan and defined in the Declaration; as such Buildings, Building Common Area, Units and Association Common Area are shown and described on the Current Phase Condominium Plan, are hereby annexed to and made a part of the Development described in the Declaration. Upon the conveyance of title to a Condominium in the annexed property or the commencement of assessments for Condominiums in the annexed property, whichever occurs first, the annexed property shall be held, sold, leased, transferred, occupied, and conveyed subject to the terms, provisions, covenants, conditions, restrictions, and easements of the Declaration and its amendments as if the annexed property were originally subject to the Declaration. (f) Notwithstanding the foregoing, certain portions of the Association Common Area shall be temporarily retained by Declarant and transferred to the Association in connection with a future Phase of the Development, as described in Section 6 of this Declaration of Annexation, and as further described in the "Declaration of Reciprocal Access Easement and Use and Maintenance Agreement (Association Common Area)," which was recorded on January 13, 2012, as Instrument No. 2012-005181 in the Official Records (the "REA"), and any amendments, modifications or supplements thereto. 3. Interests. The owner of a Condominium will receive a separate interest in a Unit and an equal undivided percentage interest in common in the Building Common Area of the Condominium Building in which that Unit is located, as described in the Declaration.
