6.1.D. - Page 43 <br /> F. Sections 5.1 and 6.2 of the Declaration provide that the Association shall inspect, <br /> maintain and repair all water systems, sanitary sewers, storm drains and drainage systems located <br /> in the Common Area not maintained by a public entity, utility company or improvement district <br /> serving the Development. (Reference is made to Sections 5.1 and 6.2 of the Declaration for <br /> further detail). Section 5.9 of the Declaration provides further that the Association shall maintain <br /> all Stormwater Improvements in accordance with the Stormwater Plan approved by the City of <br /> Redwood City ("City") and recorded on October 3, 2011, as Instrument No. 20ll-ll5421 in the <br /> Official Records of San Mateo County (the "Stormwater Plan"), including any subsequent <br /> amendments or modifications thereto. As Phases of the One Marina Development have been <br /> completed, additional water systems, sanitary sewers, storm drains, drainage systems and <br /> Stormwater Improvements located in the Common Area have been constructed and installed in <br /> the Development. In connection with the construction and build-out of Phases of the <br /> Development, the City has required that a stormwater plan be recorded to supplement the <br /> Stormwater Plan referenced above. As required by the City, such supplemental stormwater plan <br /> was recorded on , 2013, as Instrument No. , in the <br /> Official Records of the County of San Mateo, State of California (the "Supplemental Stormwater <br /> Plan"), and shall supplement the Stormwater Plan and Stormwater Improvements for which the <br /> Association shall be responsible and obligated to maintain and repair as provided in the <br /> Stormwater Plan and the Declaration. <br /> G. Sections 2.13, 5.1 and 5.5 of the Declaration provide that the Association shall <br /> inspect, maintain and repair all of the landscaping and related improvements and facilities in the <br /> Development, which includes, without limitation, the obligation to maintain those improvements <br /> designated for maintenance by the Association in any landscape maintenance agreement entered <br /> into by the Association or Declarant and the City of Redwood City. (Reference is made to <br /> Sections 2.13, 5.1 and 5.5 of the Declaration for further detail). As required by the City, a <br /> Landscape Maintenance Agreement was recorded on October 3, 2011, as Instrument No. 2011- <br /> ll5422 in the Official Records of San Mateo County. As Phases of the One Marina <br /> Development have been completed, additional landscaping, irrigation systems, lighting, paths, <br /> furnishings, bioswales and related improvements located in the Common Area have been <br /> constructed and installed in the Development. In connection with the construction and build-out <br /> of Phases of the Development, the City has required that a landscape maintenance agreement be <br /> recorded to supplement the Landscape Maintenance Agreement referenced above. As required <br /> by the City, such supplemental landscape maintenance agreement was recorded on <br /> , 2013, as Instrument No. , in the Official Records <br /> of the County of San Mateo, State of California (the "Supplemental Landscape Maintenance <br /> Agreement"), and shall supplement the landscaping and related improvements for which the <br /> Association shall be responsible and obligated to maintain and repair as provided in the <br /> Supplemental Landscape Maintenance Agreement and the Declaration. <br /> NOW,THEREFORE, DECLARANT HEREBY DECLARES AS FOLLOWS: <br /> 1. Definitions. The capitalized terms in this Declaration of Annexation shall have <br /> the same meanings given them in the Declaration unless this Declaration of Annexation provides <br /> otherwise. <br /> 2. Annexation.
