6.1.1. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> February 11, 2013 <br /> SUBJECT <br /> Agreement with Moore, lacofano and Goltsman (MIG) for On-Call Environmental <br /> Consulting Services for Projects within the Downtown Precise Plan <br /> RECOMMENDATION <br /> By motion, approve, and authorize the City Manager to execute an agreement allowing <br /> for individual project applications to be reviewed on a time and materials basis for <br /> consistency with the Downtown Precise Plan EIR, during the 2013 calendar year, with a <br /> cost not to exceed $100,000. <br /> BACKGROUND <br /> The City Council adopted the Downtown Precise Plan (DTPP) and associated <br /> Environmental Impact Report (EIR) on January 24, 2011, with minor amendments <br /> approved on September 10, 2012. Since the adoption of the DTPP the City has <br /> received multiple development proposals. Review of these development proposals can <br /> be generally characterized into two main components; 1) consistency with the standards <br /> and guidelines of the DTPP, and 2) consistency with the environmental analysis and <br /> implementation of mitigation measures identified in the EIR. <br /> ANALYSIS <br /> In an effort to keep pace with market conditions and to help streamline the entitlement <br /> process staff recommends an on-call contract with MIG (Attachment 1). City staff would <br /> be responsible for the review of downtown development proposals for consistency with <br /> the DTPP and any other development requirements, while MIG would provide a review <br /> of the development proposal to determine consistency with the environmental analysis <br /> prepared for the DTPP. MIG is particularly well suited for this task as they were the <br /> authors for the DTPP EIR. Furthermore, MIG has recently acquired Hogle Ireland, the <br /> consultant team responsible for the preparation of the General Plan. <br /> The agreement enables staff to forward pertinent proposed development materials to <br /> MIG for concurrent review. The agreement would be in place for the remainder of the <br /> 2013 calendar year, and would be revaluated at that time to determine the effectiveness <br /> of this process. Although each project would be reviewed on a time and materials basis, <br /> which is to be paid for out of the applicants cost recovery deposit, the agreement <br /> amount would be capped at $100,000. Should development demands exceed <br /> expectations and this amount, staff would return with an amendment request. <br />
