6.1.C. - Page 46 17. Entire Aqreement. This Agreemer�t, together with any other written document referred to or cor�templated by it, along wEth the purchas� arder for this Agreerr�ent and its provisions, embady the entire agraement and understanding between the parties relat�ng ta the subject matter of it. Neither this Agreement nor any of its pro�isions may be amencied, modified, waiWed or discharged except in a writing signed by both parties. 18. Severabilitv. The pro�isions of this Agreement shall be severab[e and if any phrase, clause, section, subsection, paragraph, subdivision, se�tence ar provision is adjt�dged invalid or unconstitutional by a court of competent jurisdiction, or the applicability to ar�y Praperty Owner is held ir�valid, this shall nat affect ar invalidate the remainder of any phrase, clause, section, subsectior�, paragraph, subdi�ision, sentence or provision of t�is Agreement. 19. Covenant Rur�nir�a with the �.and. This A�reement will be recorded by the City in the County Recorder's Offiee of the Cour�ty of San Mateo, California at ti�e Property Owner's expense. The covenar�ts ar�d agreeme�ts cor�tained herein shali be deemed to be covenanfs running with Title to the land for the ber�efit of the City and its successors. 20. Release of Aareement. lr� the ever�t that the City defermines that the stormwater treatment measures located on the Property are no lor�ger required, then the City, at the reques� af the Property Owner shall execute a release of this Agreement, which the Property Owr�er shall record in the County Recorc�er`s Office at the Property Owner's expense. The City reserves the option to recard such release of this Agreemer�t. The storrr�water treatrner�t m�asur�(s) shall not be rema�ed from th� Property unless such a release is so executed and �ecorded. 21. Modification. This Agreement sha�i nQt be modified except by writter� instrument execut�d by the City and the Property Owner at t1�e time of modification. 5uch modifiications shafl be effective upor� #he date of execu�ion anc� shall be recorded. 22. Bindir�q Upon Heirs, Successors and Assiqns.
