EXHIBIT A <br /> a. The Owner shall open the facilities for public use during non-school <br /> hours and until dusk unless otherwise scheduled for third party use as <br /> described in Section 3 of the main agreement. <br /> b. The following conditions apply to the Parks Section and Clubhouse Section of as <br /> listed in Section II. <br /> i. Maintenance <br /> For those areas marked on the above map as Parks,Pool and Clubhouse,City <br /> shaIl have sole responsibility for maintenance and utilities and shall provide <br /> suff'icient personnel to operate and maintain such facilities,notwithstanding the <br /> fact that District will continue to have exclusive use of the area marked Pazks <br /> during school hours and for school activities. With respect to the Clubhouse, <br /> City may delegate these responsibilities to a tenant,provided however,City shall <br /> remain responsible to ensure that the tenant properly maintains said property. <br /> Maintenance shall be at a level comparable to other City parks. <br /> ii. Pool Maintenance <br /> The City sha11 maintain and operate the swimming pool at its sole expense, it <br /> being understood by both parties that the District is no longer using the <br /> swimming pool in its school programs. Should the District decide to use the <br /> swimming pool for school purposes in the future,the pazties shall amend this <br /> Agreement to provide for equitable sharing of the cost of pool maintenance. <br /> iii. Custodial Services <br /> Because use of the recrea.tional facilities provided for herein has resulted in the <br /> past,and may result in the future,in debris being scattered throughout the entire <br /> site,including the school portion,the City shall remove debris from accessible <br /> areas within the entire site,including the school portion,after weekends,on <br /> holidays,and at other periods of hea.vy usage. Said removal will be accomplished <br /> before the next school day following the weekend,holiday,or other time of use. <br /> iv. Toilet Facilities <br /> Unless District makes indoor toilets available for City and City's Users,the City <br /> shall pay for and place temporary,portable restroom facilities at the DistricYs <br /> outdoor facilities at the discretion of the District.It shall be the responsibility of <br /> the City to ensure that City's Users maintain and clean the stationary and <br /> portable toilets at the District's outdoor facilities, lock them when not in service, <br /> and remove any portable toilets when requested by the District or when the <br /> season ends. In cases where District indoor toilets aze made available to the User, <br /> the District sha11 be responsible for maintaining those indoor toilets. <br /> 3. Conditions related to the Student Safety section (18) of this document: <br /> The City may choose to allow public access to the picnic area,Club and Pool during school hours as <br /> this area is not limited to use by students,teachers and other school staff. <br />
