6.1.D. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> March 11, 2013 <br /> SUBJECT <br /> Amendment Number 1 to Agreement with Atkins Global for professional services for the <br /> 24 Hour Fitness project located at 1050 Broadway <br /> RECOMMENDATION <br /> By motion, approve, and authorize the City Manager to execute, an Amendment with <br /> Atkins Global in the amount of $11,900 to complete preparation of the 24 Hour Fitness <br /> Initial Study / Mitigated Negative Declaration (IS/MND) and authorize the City Manager <br /> to increase the amendment amount, if necessary, by up to 10% of the total agreement <br /> amount (up to $10,671) <br /> BACKGROUND <br /> On October 8, 2012, the City executed an agreement with Atkins Global to assist staff <br /> with the preparation of an IS/MND for the "24 Hour Fitness" project. The original <br /> agreement, which included sub-consultant work, was in the amount of $94,810. <br /> ANALYSIS <br /> Atkins Global is now requesting an amendment to the original agreement in the amount <br /> of $11,900. This brings the contract amount to $106,710. The amendment will cover <br /> additional costs for Atkins Global, and their sub-consultant Hexagon, to conduct <br /> additional analysis and revise the following sections of the IS/MND with additional <br /> studies: Air Quality and Green House Gas Emissions, Noise, and Traffic. <br /> In addition to the contract amount, a 10 percent contingency of $10,671 is <br /> recommended by staff, for a total contract authorization of $17,381. The contingency <br /> would be used only if necessary to respond to unanticipated issues and to maintain <br /> work quality and schedule. This funding could also be used to support a greater than <br /> anticipated effort for preparing the responses to comments on the IS/MND. Staff <br /> requests that the City Council authorize the City Manager to use the contingency fund <br /> as needed to complete the project. Sun Cap Properties (Developer for 24 Hour Fitness) <br /> will fund these expenses. It is anticipated that the IS/MND will be released for public <br /> review late February or early March and Planning Commission consideration late April <br /> or early May. <br /> ALTERNATIVES <br /> Do not authorize execution of Amendment Number 1 to the Atkins Global agreement. <br />
