Alsa, a commercial zone allowing <br /> residential or resic[entiai compatible ser�ices (i.e., sociaf services, offices) would be suitable <br /> for shelters. For example, Sacramento County permits �mergency shelters in its commercial <br /> zone alang with other residential uses and uses such as retaif that are compatible with <br /> residential. <br /> SB 2 cfarifies existing �aw by requiring zaning identified for emergency shelters to incfude <br /> sufficient capacity to accammodate the need. The identified zane(s) must have sufficient <br /> capacity, when taken as a whole, to meet the need fior shelters identified in the housing <br /> element, and have a realistic patential for de�elopment or reuse opportunities in the planning <br /> period. Further, cap�city for emergency shelters must be suitable and a�aiEable and account <br /> for physical features {fl�oding, seismic hazards, chemicaf contamination, other environmental <br /> constraints, and slope instability or erosian) and location (proximity ta transit, job centers, and <br /> �ublic and community services). The element sho��d a�sn address a�ailabi� acreage {vacant <br /> or underutilized) and the realistic capacity for emergency shelters in the zone. Far exampfe, <br /> if a jurisdiction identifies the �ublic institution zoning district as the zone where emergency <br /> shelters will be allowed wifhout a conditional use permit, the elem�n� should demonstrate <br /> sufficient acreage within the zoning district that could accommodate the actual development <br /> of an emergency shelter. The efement could also discuss the potentia! for reuse or <br /> conversion of existing buildings to emergency sheiters. <br /> SB 2 ensures that each local government shares the responsibility to pro�ide opportunities <br /> for the de�elopment af emergency shelters. Regardless af the extent nf need identified in the <br /> elemenf, local go�ernments must provide zoning to aflow at least one year round emergency <br /> shelter, unless the need for emergency shefters is accommadated through existing shelters <br /> or a multi-jurisdictional agreement (see discussion below). Tf�is is especially impor�ant given <br /> the fact that th� homeless popufation is not always �isible in the community; is sometimes <br /> transitory; data resources are frequently inadequate and the availability and adequacy of <br /> serv�ces an� programs �ary sigr�ificantly by community and can impact the homefess count. <br /> !f a local government's existing zoning does �ot allow emergency shelters without a <br /> conditional use perrnit or other discretianary act�an, the housing element must incfude a <br /> pragram to identify a specific zone(s) and amend the zoning cade within one y�ar of adopfion <br /> of the housin element(65583(a}(4)). The anly exceptions permitfed to the non-discretionary <br /> zoning requirement are where a jurisdiction d�monstrates their hameless needs can be <br /> accommodated in existing shel#ers; or where #he jurisdiction meets all of its need through a <br /> multi-�urisdictional agreement (discussed in later sections). <br /> Where a lacal go�ernment has identified a zone and sufficient capacity to encourage <br /> emergency shelters consistent with the provisions of SB 2, a local go�ernment may a[so <br /> identify additional zones for the de�elopment of emergency s�elters that require a candit�onal <br /> use permit. <br /> State Departmenf of Housing -9- May 2008 <br /> and Community Development <br />
