7.B. - Page 24 <br /> �Chapfer fi33, Stafutes of 200T(SB 7)� <br /> The Housing Accountability Act <br /> To promate predictability for the deve�opment of housing affardable to lawer- and moderate- <br /> income househoEds, the Hausing Accountabifity Act �Ga�ernment Cocle Sectian 65589.5) <br /> prohibits a jurisdictio� from disappro�ing a hausing developmen� project, including hausing <br /> for farmworkers and for very faw-, low-, or moderate-income housel�olds, or conditioning <br /> appro�al in a manner that renders the project irtfeasible for de�elopment for the use ofi very <br /> law-, low�, or moderate-income households, including through the use of design re�iew <br /> standards, unless it makes at least one of five specific written findings based on substantia� <br /> evidence in the record (Government Code Section 65589.5). <br /> 5B 2 adds emergency shelters to the �ist af uses pratected under the Housing Accountability <br /> Ac#. In a�dition, SB 2 clarifies that the definition of a ho�asing de�eiopment project includes <br /> transitional or supportive housing {s�� Attachment 1: SB 2 - changes ar� underlined}. <br /> Zoning lnconsistency <br /> Pursuant to the Housing Accountability Act, a lacal go�ernment is prohibited from making <br /> the fnding regarding zon�ng and genera! plan inconsistency (SECtion 65589.5(d){5)) to <br /> disapprove a development if the jurisdiction identified the site in its general plan (e.g., hausing <br /> or land-use elemen�) as appro�riate for residentiaf use at ti�e density propased or fai[ed to <br /> id�ntify adequate sites tn accommodate its share of the regional housing need for al! �ncome <br /> groups. Ir� additian ta extending these pro�isions to emergency shefters and transitional <br /> housing, SB 2 prohibits the use af the zoning and genera� plan inconsistency finding to <br /> disapprove an emergency shelter if the jurisdicfians have: <br /> • not identifed a zone(s} where emergency shelters are allowec! as a permitted <br /> us� w�thaut a conditiona� use nr other discretionary permit, <br /> + not derr�anstrated the identi�ied zone(s} include sufficient capacity to <br /> accammodafe the neecf for emergency sheEter, or <br /> • not demanstrated fihe identified zone{s) can accommodate at least a�� <br /> emergency shelter. <br /> This pro�ision a�plies ta any site ider�tified in any element af the general plan for industrial, <br /> commercial, or multifamily residentiaf uses.
