, 12/21/2010 <br /> ORIGINAL <br /> RESOLUTION NO. 15073 <br /> RESOLUTION AUTHORIZING CITY TO VACATE CHEMICAL WAY IN <br /> THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION <br /> 9, CALIFORNIA STREETS AND HIGHWAYS CODE OF THE STATE OF <br /> CAUFORNIA <br /> WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) <br /> of Division 9 of the California Streets and Highways Code, the City Council of the City of <br /> Redwood City ("City Council"), hereby vacates a City right-of-way known as Chemical <br /> Way located in the Woodhouse Industrial Park Area, and the portion of Chemical Way <br /> to be vacated is attached hereto as Exhibit A (Woodhouse Industrial Park Subdivision <br /> Map) and Exhibit B (legal description); and <br /> WHEREAS, because there are in-place utilities that are in use, vacation of <br /> Chemical Way is subject to a reservation and exception from vacation of an easement <br /> and right to construct, maintain, operate, replace, remove, or renew public utility <br /> facilities, unless the City Council determines the public convenience and necessity <br /> require otherwise; an <br /> WHEREAS, on December 6, 2010, the City Council adopted a resolution of <br /> intention to vacate Chemical Way, and setting a public hearing for December 21, 2010; <br /> and <br /> WHEREAS, pursuant to said provisions of the California Streets and Highways <br /> Code, notice of intention to vacate the herein described portion of the Woodhouse <br /> Industrial Park Property was published and posted in substantially the form attached <br /> hereto as Exhibit C (public hearing notice); and <br /> WHEREAS, on December 7, 2010, the Planning Commission found that the <br /> vacation of Chemical Way is consistent with the City's New General Plan, and a copy of <br /> the Resolution so finding is attached hereto as Exhibit D; <br /> WHEREAS, the City also sent utilities notice of its intention to vacate in <br /> substantially the form attached hereto as Exhibit E (Notice to Utilities) as well as notice <br /> to property owners within 300 feet; <br /> WHEREAS, City held a public hearing on December 21, 2010 to hear evidence <br /> offered by interested persons and to determine from all of the evidence submitted <br /> ATTY/RESO/RES0.2078 #15073 <br /> 121310 MUFF#606 <br /> 1 <br />
