6.3.E. - Page 7 Section 3.1.8 Water Sunulv A�reement Amendment Required San Francisco may not change the �xisting conditian af the Hetc� Hetchy Reservoir by: (1) abandaning or decoznmissioning �'Shaughnessy Dam; or (2) draining Hetc�► Hetchy Reservoir, except for purposes of{i) repair, rehabilitation, maintenance, improvement, or reconstruction of O'Shaughnessy Dam or appurtenances, {ii} supp2ying water to the Bay Area during drought, or (iii) meeting water release requir�ments und�r the Raker Act, or federal or state law, unless the parties enter into an amendment to the Water Sugply Agreement, in full force and eFfect, adap�ed in accordance with Section 2.03. The amendment shall state, ar restate, as the case cnay be: A. The level of service goals for seismic reliability and deiivery reliability adapted by the Camrnissian in canjunction with such prQposed changes to the Regionai Water System, provided such goals are at least as protective of the Wholesale Customers as the level ot service goals adopted by che Cammission on Octo�er 30, 2008 in conjunctian with the WSIP; B. The Ievel of water guality to be de�ivered, which is curren[ly provided for in Section 3.48, ar�d G The specific cost allocation procedures, written as an amendment ta Article 5, which apply to (1) th� abandonment or decommissioning of O'Shaughnessy Dam, or {2) the draining of Hetch Hetchy Reservoir, and {3} the deveioprnent, operation and maintenaz�ce of New Regional Assets that may be required to replace water supplied by Hetch Hetchy Reservoir and delivered to the Bay Area.
