PUBLIC UTiLITiES COMMISSI4N 6.3.E. - Page 9 C�ty and County of San Francisco RESOLUTION NO. 13•4(}22 WHEREAS, in Resalution 09-0069 the Commission approved the Water Supply Agreement between the City and County of San Francisco and WholesaIe Customers izt Alameda County, San Mateo County and Santa Clara Caunry ("Water Supply Agreement"); and WHEREAS, on April 28, 2009, the 'Wholesale Customers approved the Water Supply Agreement pursuant to Section 2.03; and W�IEREAS, the Water Supply Agreement sets forth the terms by w�ich the SFPUC will groduce, and the Whol�sale Customers will purchase, water from the Hetch Hetchy Regianal Water 5ystem for a term of 2S-years begiruling on 7uly 1, 2009; and WHEREAS, Hetch Hetchy Reservoir is tlie saurce for 853'0 of the water praduced on average by rhe Regional Water System and deli�ered to 2.6 million water users in San Francisco, San Mateo, Santa Clara and A]ameda cnunties; and WHEREAS, the Water Supply Agreement requires t�-iat t�e Regiona! Water System be kept in gaod working order and repair consistent ��ith prudent utility practice and that ttte SFPUC will collat�orate with the Wholesale Customers on haw best to address passible impacts ta water supply; and WHEREAS, on November b, 2Q12, San Francisco voters considered and rejected an initiative ordinance, Praposition F, that would have requued the City to prepare a two-phase plaza e�aluating how to drain khe Hetch Hetchy Reservoir ar►d identifying replacefnent water sources; ar�d WHEREAS, the parties have deterzxained khat there is uncertainty as to how the parties would address ch.anges ta the Regional Water System in the event of fiiture abandonment ar decomrnissioning of O'Shaughnessy Dam or draini�g of Hetch Hetchy Reservoi�; and WHEREAS, the parties ha�e negotiated an amendment Eo the Water SuppIy Agreement to assure existing candition o�Hetc}a Hetchy Reservoir is rnaintained ualess the parties agree to a further amendment to the Water Supply Agreemen[ that meets certain conditians; now, [hereFore, be it RESOLVED, the amendrnent to tl�e Water Supply AgreemeAt serves a substantial public interest and it is in the interest of th� SFPUC to amend the Water Supply Agreement with the Wholesa��Customers; and, be it fiirther RES�LVED, the Commission hereby authorizes the General Manager to negotiate and execute an Amendment ta the Water Supply Agreement on behaIf of the SFPUC in substantially the form set farth in this Resolution, provided that the am�nciment is approved by the Wholesale Customers p�rsuant to Water Supply Agreernent Section 2.03; and be it further RESOLVED, the Com.mission directs staff to take all steps necessary to secure the approval of the Ame�dment ta the Agr�ement by khe Whalesa.Ie Customers; and recommends that the Wholesale Customers approve the amendment ta the Agreement, I hereby �erf�ify t'hat' ftre foregoing resolution was adopted by the Public Urilities Commission at its meeting of]anuary 22, �013. ---��. �.�DQ/' , _ Secret'ary, Pu611c Utlllttes Commrssion
