6.1.E. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> March 25, 2013 <br /> SUBJECT <br /> Informed Consent request from Liebert Cassidy and Whitmore (LCW) to allow LCW to <br /> provide advice and counsel to the Redwood City Fire Department and the San Carlos <br /> Fire Department regarding employee rights and obligations and all other matters within <br /> the statutory scope of bargaining <br /> RECOMMENDATION <br /> Authorize the City Manager to sign the attached Informed Consent regarding potential <br /> conflict of interest waiver allowing Liebert Cassidy Whitmore (LCW) to provide advice <br /> and counsel to both Redwood City and San Carlos regarding personnel related issues. <br /> BACKGROUND <br /> The San Carlos Fire Department and Redwood City Fire Department each wish to <br /> utilize the legal services of LCW to provide legal services regarding labor and personnel <br /> issues related to the full service fire agreement between San Carlos and Redwood City. <br /> LCW has recognized a potential conflict of interest as they represent both the City of <br /> San Carlos and the City of Redwood City. <br /> ANALYSIS <br /> Due to the potential conflict, LCW cannot continue representation in either agency. <br /> Currently, staffs from both agencies believe that it is in our collective interests to allow <br /> LCW to provide legal services as it relates to employment matters regarding the full <br /> service contract for both agencies. It is understood that services requested from LCW <br /> will be limited to labor and personnel matters and will not extend to general legal issues <br /> pertaining to negotiating the full service agreement. The San Carlos Fire Department <br /> has a similar item on its agenda for March 25, 2013. <br /> ALTERNATIVES <br /> Do not authorize the City Manager to sign the attached Informed Consent regarding <br /> potential conflict of interest waiver allowing LCW to provide advice and counsel to the <br /> Redwood City Fire Department and the San Carlos Fire Department. <br /> FISCAL IMPACT <br /> There are no fiscal implications at this time. <br />
