6.2.B. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> March 25, 2013 <br /> SUBJECT <br /> Final Acceptance - Amendment No. 2 to the 2009-2010 Tree Preservation and Sidewalk <br /> Repair Project <br /> RECOMMENDATION <br /> 1. Accept, by motion, the work completed during Amendment Two to the 2009-2010 <br /> Tree Preservation and Sidewalk Repair Project. <br /> 2. Authorize the release of bonds and the retention according to City procedures. <br /> BACKGROUND <br /> On June 15, 2009, a contract was awarded to SpenCon Construction, Inc. of Danville, <br /> CA, in the amount of $712,920 for the 2009-2010 Tree Preservation and Sidewalk <br /> Replacement Project ("Project") (Minute Order 09-113). The Project received Final <br /> Acceptance by the City Council on May 24, 2010 (MO 10-183). The Agreement allowed <br /> for up to four consecutive one-year extensions with a maximum yearly increase of five <br /> percent. Amendment Number One to the Agreement was issued in the amount of <br /> $500,000.00 on July 26, 2010 with a 1.33 percent increase above the original <br /> Agreement bid item amounts (MO 10-132). On July 11, 2011 Amendment No. 2 was <br /> awarded to SpenCon in the amount of $525,000.00, with a five percent increase in bid <br /> item prices and authority was given to the City Manager to increase the contract amount <br /> up to ten percent of the amount awarded if necessary (MO 11-111). <br /> ANALYSIS <br /> The work completed during Amendment Two was located on Oak Ridge Drive, Harding <br /> Avenue, Hillcrest Drive, Lancaster Way, Alameda de las Pulgas, Brewster Avenue, <br /> Stanley Street, Westgate Street, and Hopkins Avenue. Fifty-three curb ramps were <br /> installed, 22,000 square feet of sidewalk was replaced and over 12,000 linear feet of <br /> curb and gutter were replaced. The Public Works staff has reviewed and approved the <br /> work performed under Amendment No. 2 as meeting required specifications and City <br /> standards. The project exceeded the contract amount by $9,189, or approximately 2 <br /> percent. <br /> ALTERNATIVES <br /> The contractor has performed its work to accepted industry standards and is due its <br /> retention. <br /> FISCAL IMPACT <br />
