6.2.A. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> April 8, 2013 <br /> SUBJECT <br /> Final Acceptance of Work Completed pursuant to Amendment Number 3 to the Cost <br /> Shared Sidewalk Repair Project <br /> RECOMMENDATION <br /> Accept by motion the work completed pursuant to Amendment Number 3 to the 2009- <br /> 2010 Cost Shared Sidewalk Repair Project and authorize the release of bonds and the <br /> retention according to City procedure. <br /> BACKGROUND <br /> On July 27, 2009, the City awarded the 2009-2010 Cost Shared Sidewalk Repair <br /> Contract in the amount of $241,025 to SpenCon Construction Inc., of Danville, CA <br /> (Minute Order 09-154). The original agreement included the option for four extensions <br /> using relevant fluctuations in the Construction Cost Index for the San Francisco Bay <br /> Area, listed in the Engineering News Record, to adjust bid item values. Amendment No. <br /> 1 for $244,230 was approved by Council on September 27, 2010 (MO 10-183), <br /> Amendment No. 2 for $140,000 was approved by Council on August 22, 2011 (M0.11- <br /> 138), and Amendment No. 3 for $150,000 was approved by Council on June 11, 2012 <br /> (MO 12-110) for a total contract amount of $775,255. Authority was granted to the City <br /> Manager to increase the contract amount by up to 10% for each of these amendments. <br /> ANALYSIS <br /> The sidewalk repair project has been completed to the satisfaction of City staff and <br /> pursuant to the contract's plans and specifications. Therefore staff recommends that the <br /> City Council accept the improvements, release retention in the amount of $16,034.54, <br /> and release the performance bond and labor and material bond. <br /> Work completed pursuant to Amendment No. 3 included over 8,000 square feet of <br /> sidewalk, 937 linear feet of curb and gutter, over 3,000 square feet of driveway and one <br /> ADA curb ramp. <br /> ALTERNATIVES <br /> Council may choose not to accept the project nor authorize the release of retention and <br /> bonds which would be contrary to contract terms, prior Council action and the public <br /> contracting code. <br />
