Call to Order— Chair <br /> 2. Roll Call -As noted above. <br /> 3. Public Comments—There was no public comment <br /> NOTE: Speakers are limited to three minutes, unless modified by the Chairperson. The Board cannot take action on any <br /> matter raised under this item. Chair <br /> 4. Approval of Minutes—December 5, 2012 Meeting Chair <br /> M/S Christensen/Navas with submitted edits from Member Christensen and Member Navas noting he voted yes <br /> on item item 6. Motion carried unanimously by those present. <br /> 5. Recommendation to Approve the Second Due Diligence Review Brian Ponty <br /> There were no comments. <br /> MS Aguirre/Abbors to close public comment. <br /> Mr. Ponty reported out on the visit to Sacramento and how the City's efforts were unsuccessful. He said a demand letter has <br /> been submitted by the County Controller and staff is meeting with the City Council to ascertain the course of action. Member <br /> Navas inquired about the pension calculations and if any questions came up. Mr. Ponty said that was not the case. He added <br /> that the agreement the Oversight Board approved will go to the City Council on January 28, 2013. Mr. Navas inquired if OBs <br /> legal counsel should inquire with the DOF on this and seek an opinion. Mr. Ponty said that sooner or later staff will know <br /> where they stand but for now the action will be to place it on the fourth ROPS and then see if questions are asked. Member <br /> Christensen added that South San Francisco requested an opinion and the response was inconclusive. One Member inquired if <br /> there is a precedent of CalPers allowing jurisdictions to catch up on their OPEB (other post employment benefits) and Mr. <br /> Ponty said that the DOF is different from CalPers, and they are two separate state agencies. Vice Chair Roberts asked about <br /> the agreement with Legal Aid and if has the force of law. City Attorney Thompson confirmed that it did. <br /> M/S Christensen/Roberts to adopt the second DDR and approve the resolution. Motion carries unanimously. <br />
