B - 12 EXHIBIT "A" MBIA MuniServices Compar.ì (MMC) shall provide to the City of Redwood City, MMC's Tax Compliance Services which c,!)nsists of Business L'cense Discovery, Audit and Recovery Services. OBJECTIVE The objective of MMC's Tax Compliance Service is to assist the City of Redwood City in realizing all of the tax revenue to which it is entitled from entities subject to taxation by Redwood City's ordinances. MMC's Tax Compliance Services identify and recover deficiencies caused by non-reporting and under-reporting entities. SERVICE PROCEDURES MMC's Tax Compliance Service is conducted as follows: 0 Meet with City of Redwood City staff to review service objectives and scope, procedures, entity relations and logistical matters; establish an appropriate liaison with Redwood City management and staff and logical checkpoints for measuring progress; 0 Obtain authorization from Redwood City regarding which local tax ordinances will be subject to MMC's Tax Compliance Service (e.g. - Business License) Discovery Services - Phase 1 of Project Discovery Services are designed to identify entities subject to taxation by Redwood City which are not properly registered with Redwood City or otherwise not reporting taxes to Redwood City, In performing the Discovery Services, MMC shall: 0 Establish a comprehensive inventory of the entities subject to taxation by Redwood City and the database elements needed to facilitate a comprehensive comparative analysis with Redwood City's records of those entities that are properly registered; 0 Compare MMC records with Redwood City records to identify potential non-reporting and non-registered entities subject to taxation; 0 For each unregistered or non-reporting entity identified and confirmed, assist the entity, as necessary, to complete Redwood City's applicable registration form(s) and determine the amount of tax due for current and prior periods (plus applicable interest and penalties, where appropriate); 0 Ensure that all submitted registration forms are completed correctly and in their entirety; 0 Forward all completed registration forms and associated payments to the City in batches at the frequency directed by the City; 0 If the City elects to have MMC conduct payment deposit services, applications will be forwarded with copies of the payments and payments deposited into an account designated by the City; i:I Collect the amount of identified deficiencies, together wilh supporting documentation, and remit payment received to Redwood City in weekly batches (Please note: MMC will follow the City's business rules in collecting partial payments or the tax in full at the City's direction); Atty/Agr/Agr.168 021904
