7.A. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> May 6, 2013 <br /> SUBJECT <br /> Appeal of the Planned Development Permit and Vesting Tentative Map approved by the <br /> Planning Commission for the Pete's Harbor Project, located at 1 Uccelli Boulevard <br /> RECOMMENDATION <br /> Hold a public hearing and adopt a Resolution setting aside the Planning Commission's <br /> action of October 30, 2012 (Resolution No. 12-23) and remanding the application to the <br /> Planning Commission for action on the revised Pete's Harbor Project, and therefore <br /> denying the appeal of the Planning Commission's decision as moot (Attachment 1). <br /> BACKGROUND <br /> In July 2012, RWC Harbor Communities applied for a Planned Development (PD) <br /> Permit and Vesting Tentative Map. RWC Harbor Communities, LLC seeks to redevelop <br /> approximately 14 acres of property commonly known as Pete's Harbor. It proposes 411 <br /> multi-family residential units and associated parking, a clubhouse, a community pool, <br /> walkways, and public open space areas along Smith Slough, among other components. <br /> The Project is a modified version of a 2003 proposal to redevelop Pete's Harbor. <br /> The City (1) updated the environmental review pursuant to the California Environmental <br /> Quality Act (CEQA) by preparing an Addendum (2012) to the 2003 Environmental <br /> Impact Report (2003 EIR) and (2) analyzed the Application pursuant to the City's Zoning <br /> Ordinance. In September 2012, the Architecture Advisory Committee (AAC) reviewed <br /> the Project, recommended approval of the site plan and basic massing, and made <br /> recommendations regarding some design details, which the Applicant incorporated. In <br /> October 2012, the Planning Commission considered the CEQA analysis, including the <br /> Addendum (2012) to the EIR, and the merits of the Project. The Planning Commission <br /> considered the Addendum (2012) to the EIR and approved the Application (specifically, <br /> the PD Permit, including parking modifications permitted by the Zoning Ordinance, and <br /> the Tentative Map). <br /> An appeal to the City Council of the Planning Commission's action was filed by the <br /> "Save Pete's Harbor 2012" association (Appellant). The administrative appeal was set <br /> to be heard on January 28, 2013. <br /> Meanwhile, the Applicant was in discussions with the State Lands Commission (SLC) <br /> regarding potential lease amendments for portions of the outer marina and design <br /> review with the Bay Conservation and Development District (BCDC), as discussed <br />
