05/06/2013 <br /> WHEREAS, on January 28, 2013, after hearing public comment and <br /> considering the matter, the City Council continued its consideration of the <br /> matter and the appeal to May 6, 2013; and <br /> WHEREAS, on or about February 18, 2013 the Applicant submitted a <br /> letter the City to consider revisions to the Project approved by the Planning <br /> Commission; and <br /> WHEREAS, on or about April 19, 2013, the Applicant submitted updated <br /> plans for the revisions to the Project; and <br /> WHEREAS, the City Council held a duly noticed de novo public hearing <br /> on May 6, 2013 to consider the appeal of the Planning Commission action, and <br /> received and considered oral and documentary evidence on the appeal and <br /> application. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF REDWOOD CITY AS FOLLOWS: <br /> Section 1. The City Council finds that the above recitals are accurate <br /> and constitute findings in this matter and, together with the Staff Reports and <br /> the application materials, have served as an adequate and appropriate <br /> evidentiary basis for the findings and actions set forth in this Resolution. <br /> Section 2. The City Council sets aside and rescinds without prejudice <br /> the Planning Commission October 30, 2013 action on the Pete's Harbor Project, <br /> adopted by Resolution 12-23. <br /> Section 3. The City Council remands the Pete's Harbor Project <br /> application, as revised, to the Planning Commission for consideration of the <br /> updated environmental review and action on the revised Project. <br /> Section 4. The City Council denies the appeal of Alison Madden for and <br /> on behalf of Save Pete's Harbor 2012 due to its decision to set aside the <br /> Planning Commission action appealed and remand the Project to the Planning <br /> Commission for further consideration and action, which negate the need to <br /> consider the appeal thereby rendering it moot. <br /> * � * <br /> Page 2 of 2 <br /> ATTY/RES0.2849/PETE'S HARBOR RE50.#15262 <br /> REV:04-30-13 VR MUFF#603 <br />
