Developer is the current fee owner of that certain real property consisting of <br /> approximately 2.27 acres located within the City of Redwood City, Co�ulty of San Mateo, State of <br /> California, legally described in E�ibit A and depicted in E�ibit B, attached hereto and incorporated <br /> herein by reference(the"Property"). <br /> B. On October 9, 2012, the Planning Commission of the City of Redwood City adopted, <br /> among other approvals, Resolution No. 12-21, approving the Tentative Parcel Map for the Elan Redwood <br /> City residential apartment project ("Project"), prepared by BKF Engineers and dated August 31, 2012 <br /> ("Tentative Map"), subject to certain conditions of approval("Conditions"). <br /> C. The Conditions require that Developer enter into an agreement with City providing for <br /> the future construction of such public improvements. <br /> D. Developer has submitted the parcel map for the Project ("Parcel Map") and applied to <br /> City for Parcel Map approval without having completed the required public improvements and,therefore, <br /> will enter into an agreement with City providing for the future construction and installation of such public <br /> improvements,as described in the Conditions. <br /> E. Developer has submitted to City improvement plans dated April L, 2013 (the <br /> "Improvement Plans"), which, in addition to other improvements, provide for certain off-site public <br /> improvements consisting of street and street light improvements, storm drain systems, domestic water <br /> systems and sanitary sewer systems for the Project(collectively,"Improvements"). <br /> F. City and Developer desire to enter an agreement providing for the construction and <br /> installation of the Improvements in accordance with the Improvement Plans. <br />
