6.1.D. - Page 5 <br /> residential condominium units. Another Final Map for Overall Site Parcel 3 was approved by City <br /> Council on January 28,2013 and recorded on January 30, 2013 as Volume 138,Pages 90-93 in the office <br /> of the San Mateo County Recorder, divided Overall Site Parcel 3 into 115 residential condominium units <br /> and a designated remainder. An additional Final Map for the designated remainder portion of Overall <br /> Site Parcel 3 is expected to further divide the property, creating a total of 231 condominium units within <br /> Overall Site Parcels 2 and 3. These condominium units are hereinafter referred to as the "Residential <br /> Parcels." <br /> G. City and Developer desire to enter an agreement providing for the construction and <br /> installation of the Improvements in accordance with the Improvement Plans. <br /> A GREEMENT <br /> NOW,THEREFORE, in consideration of the faithful performance of the terms and conditions set <br /> forth in this Agreement,the parties hereto agree as follows: <br /> 1. Purpose. The purpose of this Agreement is to guarantee completion of the Improvements <br /> and ensure satisfactory performance by Developer of Developer's obligations to satisfy the Conditions <br /> pertaining to the Improvements. <br /> 2. Property Subject to Agreement. The Properly shall be subject to this Agreement. <br /> 3. Duty to Install Improvements. Developer will construct, install and complete, or cause to <br /> be constructed, installed and completed, at the Developer's sole cost and expense, the Improvements, in <br /> accordance with the Improvement Plans (defined in Recital E. above) and to the satisfaction of the City <br /> Engineer, in his reasonable discretion. Developer will also supply all labor and materials therefor, all in <br /> strict accordance with the terms and conditions of this Agreement. The Improvements shall include, but <br /> are not necessarily limited to,all of the following: <br /> (a) grading,paving <br /> (b) curbs,gutters,concrete walkways,driveways <br /> (c) sanitary sewer system,complete <br /> (d) water system,complete <br /> (e) storm drainage system,complete <br /> (fl site lighting system,complete <br /> (g) street trees <br /> (h) landscaping and irrigation system complete <br /> (i) stormwater treatment areas <br /> (j) utility joint trenching <br /> (k) all conditions of approval for Tentative Subdivision Map entitled"Vesting Tentative <br /> Map,One Marina,"heretofore issued for said subdivision, <br /> ATTY/AGR/2013.053/IMPROVEMENT AGR-BAIR ISLAND RD PHASE II <br /> REV:04-18-13 VR <br />
