33.Applicant's design prof�ssional shall complete NPDES Checklists, <br /> Attachments R1 and R2 of the City Standards, and pro�ide for appropriat� <br /> permanent stormwater control measures. Requirements shal! be <br /> cor�firmed at the time af the building permit issuance. For potential <br /> sofutions, the applicant may refer to "Start at Source°, a Manual developed <br /> by the Bay Area Stormwater Management Agencies Association by <br /> (BASMMA). <br /> 34. If construction is not complete by the start of the wet season (October 1 <br /> through April 30), Applicant shall implernent a winterization pragram to <br /> minimize the potential for erosion and sedimentation. As appropriate to <br /> the site and status ofi construction, winterization requirements shall include <br /> inspectinglmair�tain�nglcleaning ali soil erosion a�d sedimentation controls <br /> prior to, during, and immediately after each storm event; s�abilizing <br /> dist�rbed soils through temporary ar permanent seeding, mulching, <br /> matting, tarpEng or other physical means; rocking unpaved vehicle acc�ss <br /> to limit dispersion of much onto public right-of-way; and ca�eringl�arping <br /> stored cor�struction materials, fuels, and other chemicals. Plans to include <br /> proposed measures to prevent erosion and polluted runoff from all sife <br /> cor�ditions shall be submitted for appraval by the City Engineer prior to <br /> beginr�ing construction. As site conditions warrant, the City Engineer may <br /> direct AppEicant ta implement additional winterizatton requirements. <br /> 35.Prfor to Final Map appro�ai, the Qwner/Applicant shaEl enter [nto a <br /> Landsca�e Maintenance Agreement (LMA), in a form acceptable to the <br /> City Attorney, for al1 assigr�ed landscape areas in public right of way ta be <br /> maintained. Maintenance items shall include planting not limited to trees, <br /> shrubs, flowers, grass, and all appurtenances inckuding irrigation systems <br /> and pedestrian scaie lighting. <br /> 36.Applicant submitted preliminary draft co�enants, conditions and <br /> restrictions (CC&Rs) required by the Department of Real Estate of the <br /> State of California pursuant to Title 6 (Condaminiums) of the Califot'nia <br /> Code or other State laws or policies. Applicant shall submit revised <br /> CC&Rs fior review and approval by the Community Developmenf Direcfor <br /> and the City Attarney prior to any Final Map approvai. The revised <br /> CC&Rs shall include the follnwing: <br /> a. All property owners must E�e rnembers of their HOA. The submittal <br /> shall include an estimate of costs and proposed level of <br /> maintenance for each of the activities identified. <br /> b. The CC&Rs shalE provicfe #or funding and pro�ision af <br /> maintenance of all common facilities, such as streets and utilities, <br /> not acce�ted far maintenance by a p�blic agency.
