06/03/2013 ORIGINAL ORDINANCE NO. 2394 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AMENDING CITY ORDINANCE NO. 2180 RELATING TO REDWOOD SHORES COMMUNITY FACILITIES DISTRICT NO. 99-1 (SHORES TRANSPORTATION IMPROVEMENT PROJECT) OF THE CITY OF REDWOOD CITY THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City has previously formed the Redwood Shores Community Facilities District No. 99-1 (Shores Transportation Improvement Project) of the City of Redwood City (the "District") under the provisions of the Mello- Roos Community Facilities Act of 1982, as amended (constituting Section 53311 et seq. of the California Government Code) (the "Act"). In connection with the formation of the District and the levy of special taxes therein, on August 23, 1999, the City Council adopted Ordinance No. 2180, titled "An Ordinance of the Council of Redwood City Authorizing the Levy of a Special Tax Within Redwood Shores Community Facilities District No. 99-1 (Shores Transportation Improvement Project) of the City of Redwood City" ("Ordinance No. 2180"). Section 2. Section 3 of Ordinance No. 2180 is hereby amended in its entirety to read as follows: "The Director of Finance of the City is hereby authorized and directed each fiscal year, without further action of this City Council, to determine, or cause to be determined, the specific special tax rate and amount to be levied for each parcel of real property within the District, in the manner and as provided in the Rate and Method of Apportionment attached as Exhibit A to Ordinance No. 2180. The special tax to be levied shall not exceed the maximum rates set forth in such Exhibit A, but the special tax may be levied at a lower rate." Section 3. If for any reason any portion of this Ordinance is found to be invalid, or if the special tax is found inapplicable to any particular parcel within the District, by a Court of competent jurisdiction, the balance of this Ordinance, and the application of the special tax to the remaining parcels within the District shall not be affected. * * * ATTY/ORD.388/AMENDING ORD 2180 RELATING TO REDWOOD SHORES COMMUNITY FACILITIES DISTRICT ORD.#2394 (2"a Reading) MUfF#301 REV:OS-22-13 MLG Page 1 of 1
