Joint Facilities so as to be within its maximum capacity rights. <br /> If any Agency is unable to do so, it may, with written approval <br /> of the Authority: <br /> (i) Purchase or lease capacity from any other <br /> Agency which has surplus or unused capacity <br /> rights, or <br /> (ii) At its own expense, provide for modifications <br /> to pumping, conveyance or treatment facilities <br /> so as to accommodate its excess use of the <br /> Joint Facilities. <br /> Should any Agency fail to comply with the provisions of this <br /> Subdivision, the Authority may take any necessary action under <br /> Section 7.4 or Section 7.6.11 <br />. 3.
