'0 <br />'-, <br /> that such Ageney',s use of ,the Joint Facilities', h'as ex'ceeded, <br /> its maximum capacity rights, such Agency shall immediately <br /> take steps to reduce it.s use of the Joint Facilities so as <br /> to be within its maximum capacity rights. If 'any Agency is <br /> unable to do so, it may, with written approval of the Authority: <br /> (a) Purchase or lease capacity from any other <br /> Agency which has surplus or unused capacity <br /> rights, or <br /> (b) At its own expense, provide for modifica- <br /> tions to pumping, conveyance or treatment <br /> facilities so as to accommodate its excess <br /> use of the Joint Facilities. <br /> Should any Agency fail to comply with the provisions of <br /> this section, the Authority may take any necessary action <br /> under Section 7.4 or section 7.6. <br /> Section 7.3. Transfers. With the prior written <br /> approval of the Commission any Agency may sell, lease or <br /> assign to any other Agency any portion of its maximum capa- <br /> city rights as agreed upon by said two Agencies. Upon any <br /> such sale, lease Or assignment, the Commission shall adjust <br /> the maximum capacity rights of said two Agencies to reflect <br /> such sale, lease or assignment. Such adjustment shall be <br /> effective on July 1st of the fiscal year following such <br /> sale, lease or assignment. <br /> Any Agency may contract with any person, firm, <br /> association, corporation or public agency for any portion <br /> of its maximum capacity rights under this Agreement, but <br /> no such contract shall relieve such Agency of any of its <br /> obligations under this Agreement. <br /> 29 <br /> 1005052 <br />
