THZS AGREEMENT, dated for convenience as of J���; g , <br /> 1977, by and between the CITY OF BELMONT ("Belmont") , a general <br /> law City, the CITY OF REDWODD CITY ("Redwood City"} , a chartered <br /> City, the CITY OF SAN CARLOS ("San Carlos") , a gener�l law City, <br /> and MENLD PARK SANITARY DISTRICT ("Menlo"} , a sanitary district, <br /> each duly organized and existing in the County of San Mateo, <br /> State of Calitornia, under the Constitution and laws oE the State <br /> and collectively called the "Agencies"; <br /> W I T N E .S 5 E T H : <br /> . WHER�AS, the agencies have heretofore entered into an agreement <br /> dated November 13, 1975, entitled "Joint Exercise of Powers Agreement <br /> � - South Bayside System Authority ("the Agreement") ; and <br /> WH�REAS, the Agreement establishes the South IIayside System <br /> Authority to finance, acquire and ,'construct, and to manage, operate <br /> • and maintain the Joint I'acilities (as defined in the Agreement) <br /> for sanitary sewerage transmission, treatmerit and disposal services <br /> ' « <br /> for the Agencies; and <br /> WH�R�AS, Seetion 7.2 of the Agreement establishes maximum <br /> capacity rights in the Joint Facilities af the respective Agencies <br /> estimated as of the time of en�.ering into the Agreement; and <br /> WHER�AS, the aforesaid estimated capacity rights do not take <br /> into consideraeion changes in the design of SEage 1 of the Project <br /> (defined in the Agreement) reflective of current information and <br /> requirements of the Agencies; and � <br /> WI{LRLAS, Section 9.5 of thc 1lgreement- provides that thc <br /> �.��`�JT"rs <br />
